FORT HOOD, Texas – A judge has decided a Fort Hood shooting suspect still can face the death penalty if convicted in the worst mass shooting on a U.S. military installation. The judge, Col. Tara Osborn, on Wednesday denied Maj. Nidal Hasan´s request to remove the death penalty as a punishment option. Osborn was expected to rule later on Hasan´s request to plead guilty to 13 counts of premeditated murder in the 2009 attack on the Texas Army post. But Army rules prohibit a judge from accepting a guilty plea in a death penalty case.

Yesterday, the Senate confirmed John Kerry as Secretary of State. The vote was 94-3. Kerry’s confirmation was never in doubt. Unlike Susan Rice, Kerry did not recently exhibit willful disregard for the truth on a matter of deep public conern (the Benghazi killings), although he did slander the U.S. military four decades ago in connection with the war in Vietnam. Checking out the redesigned New Republic today, I came across this bizarre sentence in an essay by Michael Kinsley: At this point, before he remarried, [Edward] Kennedy’s dual reputation for girth and senatorial statesmanship had not yet overcome his reputation as a party boy. What does “girth” mean in this context? I honestly have no idea. European stock markets slid and the euro gained on Wednesday on news the US economy unexpectedly contracted in the fourth quarter last year and on bright eurozone confidence data. London´s FTSE 100 index of top companies dipped 0.14 percent to 6,330.39 points in afternoon deals, Frankfurt´s DAX 30 dropped 0.39 percent to 7,818.24 points and in Paris the CAC 40 shed 0.41 percent to 3,770.26 points. In Milan, the FTSE Mib slumped 2.56 percent to 17,431.79 points after energy company Saipem, a unit of ENI, warned 2012 results would fall short of forecasts and that 2013 would remain difficult.

A report from the Social Security Administration Inspector General (IG) found 4,317 instances where a non-citizen was able to obtain two Social Security numbers, including 542 instances that happened since 2001. “We identified 4,317 instances where the Numident record of 2 SSNs assigned to noncitizens contained matching first, middle, and last names; dates and places of birth; gender; and fathers’ and mothers’ names,” the IG reported on Dec. 10, 2012. Numident – which stands for Numerical Identification System – is the master file of applications for social security numbers.

In what doctors Tuesday said was a medical first, an Argentine woman with a transplanted heart has given birth to a baby girl following an in vitro fertilisation. Pregnancy after an organ transplant is always a high risk proposition because the drugs needed to ensure the transplanted organ is not rejected make pregnancy difficult, and their effects on the fetus are not clear. "There is no record in the world of a transplant patient who has achieved pregnancy through in vitro fertilization," said Gustavo Leguizamon, head of the high risk pregnancy centre in Buenos Aires, where the treatment was performed.

Attorneys have been hard at work readying appeals to National Labor Relations Board rulings since a three-judge panel unanimously ruled in Noel Canning v. NLRB that President Barack Obama violated the constitution when he stacked the board with recess appointments while the Senate was still in session. The court’s ruling does not invalidate every decision that the NLRB has made since Obama appointed Democrats Sharon Block and Richard Griffin in Jan. 2012, but it does boost the prospects of those seeking appeal. The four more years that the American electorate has granted President Obama will most likely be spent by the Republicans in feuding over the soul and destiny of their party. From the point of view of making the next Republican presidential nominee electable, it is difficult to imagine a worse strategy. After all, the last great Republican feud — the one that broke out between President Taft and Teddy Roosevelt in 1912 — ended in the election of a Democrat, Woodrow Wilson, and the current feud may put yet another Democrat in the White House in 2016.

Naples, Italy — Bus service in the southern Italian city of Naples has ground to a halt after the city transport company ran out of money for fuel. Valeria Peti, of the ANM transport company, says only 30 of the usual 300 buses left the depot Wednesday morning, and they all had to return before their tanks ran dry. The company had announced overnight that service for the morning rush hour couldn´t be guaranteed. Naples´ municipal services have been in the news before, most notably when mountains of garbage have piled up.
