If the President goes ahead and pardons General Michael Flynn — as the Wall Street Journal, in an editorial scoop, is suggesting this morning — would the United States District Court for the District of Columbia accept it? Or would Judge Emmet Sullivan proceed to try to sentence and even jail the general, despite the pardon? Those will sound like fantastic questions only if one hasn’t been following this astounding case.
That’s because the showdown over General Flynn has become a fight over what in law is called the “presumption of regularity.” It is a deference that is supposed to be accorded to government agencies.

A pardon for not committing a crime? That’s madness. Isn’t the bankruptcy, firing and smearing enough for a man entrapped and persecuted by the FBI and the DoJ? Instead of calling for a pardon of Flynn, why isn’t the WSJ calling for the prosecution of Comey, Page, Strzok, McCabe and the others who decided to prosecute Trump’s first national security advisor in order to appease Lord Obama?
Two more people who should be subject to possible prosecution are current Director Wray and the just retired FBI senior counsel, Dana Boente. From all indications, these two incredibly smug collaborators hid the exculpatory emails and notes from the federal court and Flynn’s defense team for 3+ years. It took a federal prosecutor appointed by AG Barr to have these documents released. So, don’t pardon Flynn: apologize to him for ruing his life.

What type of message would the president be sending to pardon Flynn, while retaining Wray and allowing Boente to retire at his leisure?

I won't! Pardoning Flynn supports the false assertion that he committed a crime which would allow the real crime of railroading an innocent man go not only unpunished but largely undetected.

Let's not forget a pardon entails an offense to be pardoned. And then, after falsely maintaining his guilt under oath for two years but now pardoned for a crime that DOJ still maintains he did commit, a charge that he is asking be dismissed on a "technicality", let's appoint the retired three-star to FBI Director, National Security Advisor, or Secretary of the Army...after he writes his book.

DON'T pardon Flynn. A pardon locks in the LIE that Flynn did something wrong, which he did NOT do.
Keep this going, get the case dropped.

I don't think Trump should pardon Flynn unless he has to or Flynn asks him to. While the appeals court is an unknown, and Sullivan can drag this out, I would be astonished if the SCOTUS could support Flynn being sentenced. Flynn is completely innocent and has been framed through a bureaucratic criminal conspiracy. The DOJ has withdrawn the case. He has a solid basis for a lawsuit for wrongful prosecution and that could be screwed up by a pardon. Further, the balance of powers should be asserted through the dismissal of the case.
I grant that this is going to be tough on Gen. Flynn but it would serve justice best if the legal process plays out and Sullivan is slapped down; either as the appeals court panel has directed or on final appeal if Sullivan tries to sentence him.
The Left is always twisting the law to suit their purposes. We should be trying to reassert the truth and preserve the law, even when struggling against the injustices of the Left.

It is my understanding (from a WSJ editorial) that the risk for Flynn is great. If the full court (en banc) accepts the hearing, the earlier ordered dismissal is voided. The full D.C. Court of Appeals is packed with liberals.
